§ 1-2. Definitions and rules of construction.

  • In the construction of this Code and of all ordinances, the following rules shall be observed unless such construction would be inconsistent with the manifest intent of the board of supervisors or the context clearly requires otherwise:

    Board of supervisors and board. The terms "board of supervisors" and "board" mean the board of supervisors of Cumberland County, Virginia.

    Code and this Code. Whenever the terms "Code" and "this Code" are referred to, without further qualification, they shall mean The Code of the County of Cumberland, Virginia, as designated in section 1-1.

    Code of Virginia. The term "Code of Virginia" means the Code of Virginia of 1950, as amended.

    Computation of time. Whenever a notice is required to be given, or an act to be done, a certain length of time before any proceeding shall be had, the day on which such notice is given, or such act is done, shall be counted in computing the time, but the day on which such proceeding is to be had shall not be counted. When the last day fixed by ordinance, or by rule of the state supreme court for the commencement of any proceeding, for any paper to be served, delivered or filed or for any other act to be done in the course of any proceeding under this Code falls on a Saturday, Sunday, legal holiday or any day on which the clerk's office is closed as authorized by statute, the proceeding may be commenced, the paper may be served, delivered or filed, and the act may be done on the next day that is not a Saturday, Sunday, legal holiday or day on which the clerk's office is closed as authorized by statute.

    County. The term "county" means the County of Cumberland, Virginia.

    Gender. A word importing the masculine gender only shall extend and be applied to females and to firms, associations, partnerships and corporations as well as to males.

    Highway. The term "highway" means the entire width between the boundary lines of every way or place open to the use of the public for purposes of vehicular travel in the county, including the streets and alleys, and, for law enforcement purposes, the entire width between the boundary lines of all private roads or private streets which have been specifically designated highways by an ordinance adopted by the board of supervisors.

    Number. A word importing the singular number only may extend and be applied to several persons or things as well as to one person or thing; a word importing the plural number only may extend and be applied to one person or thing as well as to several persons or things.

    Officers, agencies. Whenever reference is made to a particular officer, employee, department, board, commission or other agency without further qualification, such reference shall be construed as if followed by the words "of the County of Cumberland, Virginia."

    Or, and. "Or" may be read "and," and "and" may be read "or" if the sense requires it.

    Person. The term "person" includes any individual, firm, corporation, limited liability company, partnership, association, society, organization, agency, company, business, trust, joint venture or other legal entity or group or combination of individuals of whatever form and character.

    Preceding and following. The terms "preceding" and "following" mean next before and next after, respectively.

    Shall, may. The term "shall" is mandatory; the term "may" is permissive.

    State and commonwealth. The terms "state" and "commonwealth" shall be construed as if the words "of Virginia" followed.

    Statutory construction. The rules of construction given in Code of Virginia, §§ 1-13.1—1-13.42, shall govern, so far as applicable, the construction of all other words not defined in this section.

    Tense. Words used in the past or present tense include the future as well as the past and present.
