§ 1-8. General penalty; continuing violations.

  • (a)

    Wherever in this Code or in any ordinance of the county, or in any rule, regulation or order promulgated by any officer or agency of the county under authority duly vested in him or it, any act is prohibited or is declared to be unlawful or an offense or misdemeanor or the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, and no specific penalty is provided for the violation, the violation of any such provisions of this Code or any such ordinance, rule, regulation or order shall be a class 1 misdemeanor.

    (b)

    Whenever in this Code or in any ordinance of the county, or in any rule, regulation or order promulgated by any officer or agency of the county under authority duly vested in him or it, it is provided that a violation of any provision shall constitute a class 1, 2, 3 or 4 misdemeanor, such violation shall be punished as follows:

    (1)

    Class 1 misdemeanor, by a fine not exceeding $2,500.00 or by imprisonment in jail not exceeding 12 months, or by both such fine and imprisonment.

    (2)

    Class 2 misdemeanor, by a fine not exceeding $1,000.00 or by imprisonment in jail not exceeding six months, or by both such fine and imprisonment.

    (3)

    Class 3 misdemeanor, by a fine not exceeding $500.00.

    (4)

    Class 4 misdemeanor, by a fine not exceeding $250.00.

    (c)

    Notwithstanding any other provision of this section or any other section of this Code, no penalty for a violation of this Code or other ordinance, rule, regulation or order of the county shall exceed that prescribed by general law for a like offense. Each day any violation of this Code or any such ordinance, rule, regulation or order shall continue shall constitute, except where otherwise provided, a separate offense.
