§ 17. Safety requirements.

  • (a)

    Grantee shall at all times employ ordinary care and shall install and maintain in use commonly accepted methods and devices for preventing failures and accidents which are likely to cause damage, injuries, or nuisance to the public.

    (b)

    Grantee shall install and maintain its wires, cable, fixtures, and other equipment in accordance with the requirements of the National Electric[al] Code and any other applicable federal, state or local law, rule or regulation, and in such manner that they will not interfere with any installation of the county or of a public utility serving the county.

    (c)

    All structures, and all lines, equipment and connections in, over, under and upon public streets, sidewalks, alleys, and public ways and places of the county, where ever situated or located, shall at all times be kept and maintained in a safe, suitable, substantial condition, and in good order and repair.

    (d)

    Grantee shall ensure:

    1.

    That the safety, functioning and appearance of the property and the convenience and safety of other persons not be adversely affected by the installation or construction of facilities necessary for a cable system;

    2.

    That the cost of the installation, construction, operation or removal of such facilities be borne by the grantee; and

    3.

    That the owner of the property be justly compensated by the grantee for any damages caused by the installation, construction, operation, or removal of such facilities by the grantee.
