§ 3. Grant of authority.

  • There is hereby granted by the county to grantee the right and privilege to construct, erect, operate and maintain in, upon, along, across, above, over and under the public streets, alleys, public ways, and public places now laid out or hereafter dedicated to public use, and all extensions, thereof, and additions thereto in the county, on poles, wires, cable, underground conduits, manholes, and other television conductors and fixtures, and to use poles, wires, cables and other facilities of persons, providing consent is obtained from such persons, necessary for the maintenance and operation in the county a community antenna television system for the interception, sale and distribution of television and radio signals, to the extent that such use is compatible with the areas to which these rights and privileges pertain.

    3-1. Nonexclusive grant. The right to use and occupy said public streets, alleys, public ways and places, or the facilities of other places for the purposes herein set forth shall be nonexclusive; and the county reserves the right to grant a similar use of said streets, alleys, public ways and places, to any person at any time during the period of the franchise.

    3-2. [ Limitations. ] No franchise granted hereunder shall limit grantee to serving only one portion of the county, it being the intent of this ordinance to allow grantee to construct, operate and maintain a CATV system to all unserved portions of the county to which they desire to extend such service, subject only to the requirements of this ordinance.
